In certain circumstances, where an eligible person (defined by s57 of the Succession Act 2006 (NSW)) has been left out a will, they may have a legitimate claim to a portion of the estate. These types of cases are known as Family Provision matters. Claimants may include widows and widowers, adult children, and if eligible, grandchildren or carers.
It is important that potential claimants consult with an expert in Family Provision claims. At CCS legal, our expert team have first-hand knowledge not only of the Succession Act, but also of the workings of the Supreme Court of New South Wales. Because of the timeframes and documentary requirements of the Supreme Court with regards to Family Provision claims, failure to act quickly and/or to provide the requisite documentation within the specified timeframe may lead to the downfall of the claimant’s case.
At CCS legal, assisting our clients to achieve a successful outcome in Family Provision claims is of paramount importance. Our highly knowledgeable and experienced team are able to guide their clients through the claims process from start to finish.
